By accepting our rate offer the following conditions apply:

1. Included in the transport rate:

• TIR Carnet
• Free time:
  • 2 hours free for loading in case of FTL in Western Europe, 1 hour in case of groupage,
  • 2 days free for loading and export clearance in the EAST,
  • 2 days free after arrival to customs terminal in the EAST for unloading and clearance in case of FTL,
  • 1 day free after arrival to customs terminal in the EAST for unloading and clearance in case of groupage
• Daily update

2. Not included in the transport rate:

• Export documents: Ex1 50 EUR, T1 100 EUR. Any further guarantee or security position for customs documents should be arranged by the client. We will invoice these T1 / EX1 costs to the client.
• Convoy costs.
• Waiting day’s at the loading place or unloading place.

3. Convoy and customs:

Due to the value of the goods, customs in various CIS countries may put the trailer into official convoy. For various customs codes special convoy, licences, analyses and checks might be demanded by customs. Forthcoming costs paid for these events will be charged to the client. The freight rate includes a waiting time of 1 day at a border for convoy, more days will be invoiced at euro 250,- per day as demurrage. We are committed to inform the client about these costs on a daily basis. In case of groupage the costs to be paid per shipment for convoy will be related to the total value of the goods in the trailer. You will have to pay a percentage of the convoy costs, depending on the value of your goods.

4. General:

• Term of payment is 30 days after invoicing date without CMR. In case of ODC or convoy shipments a percentage of advance payment will be requested pending on the value of the cargo or the of the costs of the permits. New clients & non-EU clients pay all freight costs in advance.
• Prior to arrival and loading of the trailer at the loading place the client must present appropriate original freight papers (CMR, invoice), export or import documents or instructions to acquire these papers. The client needs to inform us when goods are transit goods (e.g. T1-goods).
• Client is responsible for import clearance at destination through its consignee or customs broker.
• Maximum payload of a normal trailer is 20 tons. Penalties for overweight will be invoiced to the client.
• Demurrage: 250 euro / day.
• Demurrage or other costs due to a mistake made by client or otherwise imposed by the local authorities will be charged to the client.
• The costs mentioned in our daily updates are fixed if no reaction is raised by the client within 24 hours. These costs are due immediately.
• We need pre-advise to arrange suitable transport, number of days for pre-advise highly depend on the kind of vehicle, market situation and (un)loading place.
• The transit time is an estimation of the time it will take for the truck to get to destination. Border crossing, road conditions and previous unloading addresses may influence the transit time.
• In case of an ADR shipment the rules of the ADR Treaty apply. This means amongst others that consignor shall ascertain that the dangerous goods are classified and authorized for carriage in accordance with ADR. Consignor shall furnish the carrier with information, data safety sheets and documents (authorizations, approvals, notifications, certificates, etc.) as mentioned in article 1.4.2.1. of the ADR treaty.
• In case of cancellation of a transport we will charge you all costs made for that particular transport (e.g. possible waiting costs for loading and for getting a new load, empty run to and from the loading place, permit costs) plus 9% of the transport rate as an administration fee with a minimum of 100 euro’s.
• We will keep the right to charge you with a fuel surcharge, due to the increasing of diesel price. For every 2 eurocent increase in the price of diesel we will increase the freight price by 1%.
• Groupage will be delivered to the customs terminal only.
• CMR conditions apply to all our international transports.
• 1ldm equals 1650 kg.
• All legal disputes will be settled by Dutch law and for Dutch courts.
• Acting as agent only. All business undertaken is subject to the Dutch Forwarding Condtion General Conditions of the FENEX, in its latest version
